- BASIC CONCEPTS
1.1. Company or Personal Data Controller – DVISKAITA, MB, a private limited liability company established and operating under the laws of the Republic of Lithuania with legal entity code 304895624, registered office at Verkių g. 23-29, LT-08246 Vilnius, Lithuania.
1.2. Customer or Data Subject – a natural person – a customer of the Company (including website visitors) whose personal data is collected by theCompany.
1.3. E-shop – the company’s e-shop at https://just9.art/.
1.4. Services – all services provided by the Company.
1.5. Personal data – any information relating to a natural person – a data subject whose identity is known or can be established directly or indirectly by means of data such as a personal identification number, one or more characteristics specific to a person of a physical, physiological, psychological, economic, cultural or social nature.
1.6. Processing of personal data means any act performed on personal data: collection, recording, storage, storage, classification, grouping, combination, alteration (addition or correction), provision, publication, use, logical and/or arithmetic operations, search, dissemination, destruction or other act or set of actions.
1.7. Partner – a legal entity providing services to the Company related to the activities carried out by the Company, either selling goods to the Company or carrying out joint projects with the Company, including, but not limited to, marketing promotions, joint sales campaigns, loyalty programs, etc., in media, websites, e-shop, retail stores, supermarkets, etc.
1.8. A cookie is a small piece of textual information that is automatically created when browsing a website and is stored on a visitor’s computer or other device.
1.9. Direct marketing is an activity designed to offer goods or services to individuals by post, telephone or other direct means and/or to seek their opinion on the goods or services offered.
1.10. Privacy Policy – means this document, which defines the principles and rules for the processing of Personal Data when using the services of the e-shop.
1.11. Account – basic data of the Client’s login to the E-shop, consisting of a single e-mail address and a Password.
1.12. Password is a unique combination of numbers, letters, or numbers and letters or other symbols created by the Customer, which allows you to log in to the E-shop.
- GENERAL PROVISIONS
2.1. The Customer grants the Right to the Company to perform all personal data processing actions to the extent and for the purposes provided for in this Privacy Policy.
2.2. Personal data are processed in accordance with the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal acts regulating the processing and protection of Personal Data, this Privacy Policy.
2.3. In the Company, Personal Data is processed in accordance with the following principles:
2.3.1. Personal data are collected for defined and legitimate purposes;
2.3.2. Personal data are processed accurately, fairly and lawfully;
2.3.3. Personal data shall be adequate and limited to the extent necessary for their collection and further processing;
2.3.4. Personal data shall be kept up to date;
2.3.5. Personal data shall be stored in such a form that the data subject can be identified for no longer than is necessary for the purposes for which the data were collected and processed.
2.3.6. All information about Personal Data is confidential;
2.3.7. The Client’s Personal Data and Personal Information will not be used for illegal purposes.
2.4. It is considered that the Customer, when purchasing in the E-shop, has read the Privacy Policy of the valid version and agrees with it. If the Customer does not agree with any part of the Privacy Policy or the Privacy Policy, then the Customer must not place an order and not buy the product in the E-shop.
2.5. The Privacy Policy can be accessed in the E-shop and printed at any time. The Privacy Policy may be changed, completed or updated at the Company’s sole discretion. A new version of the Privacy Policy is published in the E-shop.
2.6. The Customer can place an order in the e-shop without registration, or by registering with the E-shop through his/her Account.
2.7. During the initial registration to the E-shop via the Account, the Customer must provide his/her e-mail address and come up with a secure Password, as well as provide accurate Personal Data to the E-shop. The Client is responsible for their correctness. After the Account is created, the Client is given an identification code.
2.8. When using the Services, as well as when purchasing in the E-shop, the Customer must always provide accurate Personal Data to the E-Shop and be responsible for their correctness.
2.9. The Customer has the right to change and supplement personal data in the Account at any time or to contact the e-shop with a request to delete the Account.
2.10. The Client must not disclose the Password to third parties and store it, otherwise all related liability lies with the Client.
- COLLECTION, USE, CORRECTION AND STORAGE OF PERSONAL DATA
3.1. The Company respects every Customer’s right to privacy. The Customer’s Personal Data (i.e. name, surname, e-mail address, telephone number, delivery address of the goods/service, age/year of birth, payment data of the goods/service (bank account number, method of payment, etc.), purchase history, as well as, with the Customer’s consent, age, gender, date of birth, place of residence) are collected and processed for the following purposes:
3.1.1. For the purpose of e-commerce. The following Personal Data are processed: name, surname, e-mail address, telephone number, delivery address of the goods/service, age/year of birth, IP address, payment data of the goods/service. The duration of storage of personal data used for the purpose of e-commerce is 5 (five) years from the date of the last login to the e-shop.
3.1.2. For the purpose of direct marketing. The following Personal Data are processed: name, surname, telephone number, e-mail address, address, age, gender, date of birth, place of residence. The duration of storage of personal data used for direct marketing purposes is 5 (five) years from the date of the last login to the E-shop.
3.2. The Client may grant consent for the processing of his/her Personal Data (name, surname phone number, e-mail address, address, age, gender, date of birth, place of residence) for the purpose of Direct Marketing. If, having given his/her consent to the processing of his/her data for the purpose of Direct Marketing, as well as to receive Direct Marketing Communications, the Customer will no longer wish to do so and inform the Company thereof, the Company will no longer process his/her Personal Data for the purpose of Direct Marketing and will not send any electronic news to the Customer, except for information related to the Customer’s order.
3.3. The Customer has the right at any time to withdraw his/her consent to the Company to process the Customer’s Personal Data for the purpose of Direct Marketing by submitting a corresponding notification to the Company by e-mail info@just9.photos and expressly indicating that he/she withdraws his/her consent to use his/her Personal Data for the purpose of Direct Marketing and does not wish to receive any Direct Marketing Messages.
3.4. The Client also has the opportunity to refuse to exercise his/her right to object to the processing of the Client’s Personal Data for the purpose of Direct Marketing by clicking on the appropriate link in each e-mail sent.
3.5. As a Data Subject, the Client has the following rights related to the Client’s Personal Data Processing Procedures:
3.5.1. to receive information from the Company about the processing of the Customer’s Personal Data, to get acquainted with his/her Personal Data and how they are processed;
3.5.2. to receive information from the Company, from which sources and what personal data of the Client have been collected, for what purpose they are processed, to which data recipients are provided and have been provided at least in the last 1 (one) year;
3.5.3. to demand the rectification, destruction of the Client’s Personal Data or suspension, except for storage, of the processing of his/her Personal Data when personal data is processed in a manner that does not comply with the provisions of the Law on Legal Protection of Personal Data of the Republic of Lithuania and other laws.
3.6. When realizing his/her rights, the Client must present a passport, id card or driver’s license. The Company shall provide the Data Subject with information about the Processed Personal Data of the Data Subject once a year free of charge. The Customer may exercise his/her rights provided for in clause 3.5 by applying by e-mail info@just9.art. The Company has the right to adjust, change, delete Personal Data or suspend the processing of Personal Data only after identifying the customer who has applied.
3.7. The Client’s Personal Data is not provided to third parties, except in the following cases:
3.7.1. When the Client’s consent has been obtained, as specified in this Privacy Policy;
3.7.2. Personal data for e-commerce purposes shall be provided to Partners providing services to the Company related to the activities carried out by the Company;
3.7.3. in the cases provided for by the laws and legal acts of the Republic of Lithuania to the competent authorities.
3.7.4. In the e-shop, payments are processed using the Swedbank payment collection platform with the manager „Swedbank“, AB (Konstitucijos pr. 20A, Vilnius, Lithuania, reg. nr.: 112029651), so your personal information required for payment execution and confirmation will be transmitted to this entity.
3.8. The Client is aware of his/her right to object to the processing of his/her Personal Data for the purpose of Direct Marketing, i.e. The Client has the right to express disagreement immediately, or later.
3.9. The Customer agrees that his/her Personal Data will be transferred to the Partners when executing the Customer’s order submitted in the E-shop, as well as when the Company provides the Services to the Customer, as well as to the Company’s Partners as specified in 3.7. see point 2.1.
3.10. If the Customer does not agree with the Privacy Policy, the Customer will not have the opportunity to use the e-shop services.
3.11. The Company implements organizational and technical measures to protect Personal Data from accidental or unlawful destruction, alteration, disclosure, as well as from any other unlawful processing.
3.12. The Client agrees that in cases where it is necessary in accordance with the instructions of the competent authorities and/or the Client’s Personal Data has been potentially used in the course of illegal activities, or there are reasonable suspicions about the theft of a person’s identity, for which the competent law enforcement authorities are conducting a pre-trial investigation, or there are other legitimate grounds or purposes, his/her Personal Data would be stored on the Company’s servers longer than provided for in this Privacy Policy.
3.13. Upon receipt of the Data Subject’s instruction or request related to the processing of Personal Data, the Company shall provide the Customer with a response, granting the request/instruction or refusing to do so in a reasoned manner, no later than within 30 (thirty) calendar days from the date of the Data Subject’s request. If the Data Subject so requests, a reply must be given in writing.
3.14. In order for the Company to offer full-fledged services to the Customer in the E-shop, the Customer’s consent saves information Cookies on the Customer’s computer (device). cookies),which is used to identify the Customer as a previous user of the e-shop, collecting e-shop traffic statistics, information about the shopping cart. The Customer may review what Cookies are saved at any time and may delete some or all of the saved Cookies.

- OTHER PROVISIONS
4.1. The Company has the right to change, supplement the “Privacy Policy” in whole or in part. Additions or changes to the Privacy Policy shall take effect from the date of their publication.
